Portal User Terms

Version 2026-10-17 · Effective October 17, 2026

Operator: ESAMA HOMES LLC, a Florida limited liability company, 7765 Lake Worth Road, Suite 1062, Lake Worth, FL 33467, support@esamahomes.com ("eSamaHomes", "we", "us").

These terms apply to you if a landlord or property management company (the "Customer") invited you to use eSamaHomes as a tenant or applicant, a property owner, or a vendor. Using the portal is free for you. You also agree to the Privacy Policy.

B1. Who you are dealing with

eSamaHomes is software. The Customer who invited you uses it to manage the property.

  • Your relationship is with the Customer, not with us. Your lease, your management agreement or your work order is between you and the Customer. We are not a party to it.
  • We are not your landlord, property manager, broker, bank or payment company. We do not hold your money or decide anything about your tenancy, property or work.
  • The Customer decides what you can see and do in the portal, and can remove your access.
  • Questions about rent, charges, repairs, statements or payments go to the Customer. Their contact is in the portal.

B2. Your account

  • You must be at least 18.
  • Sign in with your own account. Keep it secure and do not share it.
  • Tell the Customer and us at support@esamahomes.com if you think someone else used it.
  • Use the portal only for your own property, lease or work. Do not try to reach other people's information, break our security, or upload anything harmful.

B3. Messages, requests and notices

  • Messages, maintenance requests and reminders in the portal go to the Customer, but they can be delayed or missed.
  • The portal is not for emergencies. For fire, flood, gas, break-ins or anything dangerous, call 911 and use the emergency contact in your lease.
  • A portal message is not a legal notice unless your lease and the law say it can be. Send and expect legal notices the way your lease and the law require.

B4. For tenants

Rent and balances

  • Your lease decides your rent, due date, late fees, deposit and other charges — not eSamaHomes.
  • The balance in the portal is a convenience. If it looks wrong, ask the Customer. Your lease and the Customer's records control.

Paying online

  • You pay by linking your bank account. Stripe, our payment provider, verifies your account and processes the payment.
  • Your payment goes to the Customer's Stripe account. It does not pass through eSamaHomes.
  • eSamaHomes charges you no fee.
  • Bank payments only. You can't pay by card in the portal.
  • A bank payment takes up to 4 business days to clear. While it does, the portal shows it as "processing". A payment that is processing is not yet paid, but you are not charged a late fee for it while it processes.
  • If a payment fails before it clears, you and the Customer are told. The rent is unpaid again, and your lease's late-fee rules apply from then. eSamaHomes does not try the payment again on its own: pay again from the portal, or another way the Customer accepts.
  • A payment can also be returned after it looks complete, for example if there is not enough money in your account. A returned payment means your rent is unpaid. Your lease may allow the Customer to charge a fee for it. After a late return, that bank account can't be used again in eSamaHomes, and auto-pay from it is turned off.
  • Refunds and payment disputes are handled by the Customer.

Auto-pay

  • Auto-pay is your choice. When you turn it on, Stripe shows you the authorization for automatic bank payments, and you agree to it there.
  • Auto-pay pays the balance due on each rent invoice, on its due date, from the bank account you choose.
  • To cancel auto-pay, turn it off any time in the portal. Turn it off at least one business day before a due date to stop that month's payment.
  • If several tenants are on a lease, one of them runs auto-pay. Only that tenant can turn it off. Another tenant on the lease can take it over from their own bank account.

Applications and screening

  • If you apply for a home, the Customer may order a background or credit check from TransUnion SmartMove. TransUnion contacts you and asks for your information and permission in its own screens, under its own privacy policy. eSamaHomes sends TransUnion nothing.
  • The Customer — not eSamaHomes — decides whether to approve your application, and must give you any notice the law requires.

Documents

  • The Customer may share your lease and other documents with you in the portal. Keep your own copies of anything important.

Signing your lease online

  • The Customer may send your lease to sign online through our signing provider. You first agree to sign electronically (esamahomes.com/legal/esign-consent) and enter a code sent to your email. You can ask the Customer to sign on paper instead.
  • The lease is between you and the Customer. eSamaHomes does not write it and gives no legal advice about it.
  • When everyone has signed, the signed lease appears in your portal.

B5. For property owners

  • The property manager (the Customer) decides what you see: statements, balances, reports, maintenance requests.
  • Statements and balances are the manager's records. They are only as correct as what the manager enters. They are not an audit.
  • Your money is handled by your manager, not eSamaHomes. Rent, reserves and payouts to you are between you and your manager, under your management agreement.
  • Repair approvals you give in the portal are instructions to your manager.

B6. For vendors

  • You work for the Customer, not for eSamaHomes.
  • Quotes, work orders and invoices you submit go to the Customer. Payment terms are between you and the Customer. We do not pay vendors.
  • Documents you upload, such as a W-9 or insurance certificate, are shared with the Customer.

B7. Your information

  • The Customer controls the records about you in their account. To see, correct or get a copy of those records, ask the Customer first. You can also write to us at privacy@esamahomes.com.
  • How we handle personal information is in the Privacy Policy.
  • When the Customer removes you, or closes their account, your portal access ends. Ask the Customer for copies of anything you need before that.

B8. Liability

To the extent the law allows:

  • We are not responsible for your lease, your property, repairs, charges, payments, screening decisions, statements, work orders, or anything the Customer, other users or third-party companies do or fail to do.
  • The portal is provided "as is". It may be unavailable at times.
  • Because the portal is free for you, our total liability to you for any claim is limited to $100.

Nothing here limits rights you have under the law that cannot be limited, including your rights under your lease and landlord-tenant law.

B9. Changes

We may change these terms. We will post the new version with its date. For important changes we will ask you to accept the new version before you continue.

B10. Law and disputes

Florida law applies. Disputes with eSamaHomes go to the state or federal courts in Palm Beach County, Florida, unless the law gives you the right to another court. Please write to support@esamahomes.com first so we can try to solve it. There is no required arbitration. Disputes with the Customer are between you and the Customer.
